Research On The Home Leave System

The system of family visit leave in China has played an important role in the specific social conditions and historical background.As a law that meets the emotional needs of employees and is full of humanistic care,the home leave system is unique and of advanced significance.To a certain extent,the implementation of the family visit system in China solves the problem that employees cannot get together because of the separation of work and family members,promotes the construction and development of the country,stabilizes the family life of employees,and shows the concern of the country for workers.However,with the development and change of the times,the system of home leave has not been revised yet,which makes the system gradually forgotten by people.With the rapid development of national infrastructure construction and the earth shaking changes in means of transportation and communication conditions,the implementation environment of the system of home leave has changed,and even fell into a situation of survival.With the promulgation of the law of the people’s Republic of China on the protection of the rights and interests of the elderly,the problem of empty nest family is becoming more and more serious.The system of family visit leave has once again come into people’s sight,causing discussion among the masses,scholars and representatives.Whether it is necessary to keep the home leave system has become a focus of argument.This paper is divided into three parts.In the first part,the author introduces the related concepts of home leave system.First of all,it expounds the concept and characteristics of the legal system of home leave.Secondly,it introduce the legal characteristics of home leave system.Especially the home leave system is the reflection of human right.Thirdly,this paper compared the home leave system with other rest vacation,made people realize the difference of home leave system with other leave system.Finally,this paper analyzes two main view of home leave system that are cancel the home leave system and reservation of the home leave system,and expounds the author’s views and reasons for retaining the system of family visit leave.In the second part of this paper,it introduces the relevant laws and regulations of the current home leave system,and discusses and analyzes the problems existing in the legal system of home leave,such as the limitation of the subject and object of home leave is too narrow;the conditions and setting of leave are not scientific;the road fee and economic compensation for home leave are unreasonable;the absence of government responsibility and legal responsibility are unclear.The third part of this paper,in view of the problems existing in the legal system of home leave,puts forward corresponding solutions and suggestions one by one,from the application of home leave,holiday design,government responsibility and legal protection and other aspects of comprehensive reform,with a view to improving home leave,making home leave play a role in modern times,and solving practical social problems.
