The laborer is not only the employee of unit of choose and employ persons,also be the pillar of the family;They should not only get to and from work on time and complete the work tasks of their work units,but also bear multiple responsibilities such as taking care of their families,raising their children and supporting the elderly.The fulfillment of these family responsibilities requires not only the material guarantee of the laborer's salary and remuneration,but also the escort and care under special circumstances.Therefore,there is a time conflict between the completion of the work of the laborer and the care of the family.Although there is no family care leave in China,it can be found from the review of existing normative documents in China that both family care leave at the national legislative level and paternity leave and nursing leave at the local legislative level are aimed at making legislative efforts to balance the work and family care of laborers.However,unfortunately,due to the single salary model,high labor costs,lack of security means and other reasons,these legislation has not been effectively implemented.This situation not only damages the seriousness of laws and regulations,but also makes the social contradiction of how to take care of both work and family become more prominent with the emergence of population aging and second child birth.Therefore,this article is divided into four parts,starting from the basic theory of family care of false,comb in the holiday of holiday of our country home leave,carers,nursing,and on the basis of present vacation system,this paper introduces the good for,a day represented by the family to take care of the holiday,then comparative analysis the holiday of holiday of home leave,carers,care in our country,and these holidays exist in the current holiday system of legislative level is not high,hidebound patterns of vacation,business pressure is too large,the absence of government responsibility,the paper analyzes between vacation,Finally,it puts forward Suggestions on the construction of China's family care leave system and the improvement of China's leave system from the aspects of legislative purposes,system construction,vacation mode,government responsibility and relief mechanism,so as to realize the harmonious balance between work tasks and family responsibilities and promote the harmonious development of labor relations.
