The Legal Protection Of Information On The Network Activity Trajectory

In the era of big data on the Internet,more and more frequent use of mobile terminals will produce a lot of "network activity trajectory" information,so the collection,use and disclosure of these information are becoming more and more commercialized.The case introduced in this paper is a hot issue caused by the use of "network activity trajectory" information of users.At present,in the legislative level of our country,there is no clear definition and protection of such users "network activity trajectory" information.At the theoretical level,there is also a lack of in-depth discussion,which leads to two completely different judgments in the trial practice between the court of first instance and the court of second instance.Although the user's "network activity trajectory" information belongs to the individual user,it is also controlled by the Internet service provider.How to balance the rights and interests between users and Internet service providers requires us to study and explore in depth.Through literature research,case analysis and normative analysis,this paper takes the case as the breakthrough point,studies and judges the current situation and problems of Internet users "trajectory of network activities" information and personal information in China,and finally gives some suggestions on personal information protection from the aspects of legislation,government supervision and industry self-discipline.With the rapid development of the Internet in China,we can establish and improve the legal system and industry system of personal information protection,consolidate the foundation of the law and industry,connect every existing point into a line,and finally form a surface,so as to avoid the huge risk brought by the rapid development of the industry to Internet users.
