Analysis Of Legal Protection Of Consumer's Privacy Rights

As the rapid development of the economy of our country, the infringements of privacy have gradually increased. This has aroused people's high attention. But the research of the law protecting system start too late, there isn't any specific law to regulate consumer's privacy rights. People often protect their privacy indirectly, mainly through other channels, such as violations of the right reputation. The protection is too weak. and it cann't keep up with the economic development .Base on this reason, this paper takes deeply and completely thought on the legal protection of consumer's privacy issue, Hope to enrich the protection to the content of consumers' rights .The paper includes five parts.The first part discusses the general conception of consumers' privacy rights. Firstly, I define the Consumer's privacy right and think it is free personality rights which belong to the natural person when they are buy and use goods or accept the service for lives. Personal information, personal activity and personal area should be protected by law and shouldn't be disturbed ,known ,collected and opened by others. Secondly, discusses its context. Such as rights of choice, the right in the know, control rights, and the private income rights. Thirdly, analyzes the behaviors of the infringements of privacy through our reality.The second part analyzes the reason for protection of the consumers' privacy rights, mainly discusses the consumer's weak status with the privacy protection and the consumer's personal formation property character.The third part studies the conditions of legislation on legal protection of privacy rights through comparison and its enlightenment. By the means of studying the conditions of legislation on legal protection of privacy rights in some countries and regions in the world; and analyzing on the legislative protections which includes direct protection, indirect protection and general protection by comparison, come to the conclusion that we should construct the law system.The fourth part discusses the present conditions of privacy rights' protection in our country. As the privacy rights protection is the base of the consumer's privacy rights protection. So we firstly analyzes the present conditions of privacy rights' protection in our country. Then, analyzes the shortcomings of legislation of privacy rights' protection in our country.The fifth part discusses how to improve the legal protection of consumer privacy legislation. .firstly, discusses the general ideas for constructing law system of protection ,secondly, discusses the specific aspect of constructing law system which includes constructing law system of protection from constitution; constructing law system of protection from civil; constructing law system of protection from consumer's right protection law; constructing law system of protection from criminal law and constructing law system of protection from personal information protection law; constructing law system of protection from consumer's right protection law.
