Research On The Licensing Mechanism In The Regulation Of Online Vehicle Restriction

“The Interim Measures”promulgated at the national level established the legal status of network rental car from the legal point of view.Local governments have successively formulated local rules within the framework of the Interim Measures.The administrative licensing system is the core mechanism in the regulatory framework of network rental car,but its source is flawed in legitimacy.The basis of the upper law of permission in the local rules varies according to the legal rank.The sources of licensing are not uniform.The specific provisions on access do not match the relevant legal documents.In view of the licensing mechanism in the regulation of online car hailing,this paper looks forward to the following four aspects: first,the establishment and refinement of licensing mechanism;second,the clarification of licensing mechanism and market competition;third,the reasonable establishment of access conditions for online car booking;and fourth,the improvement of the auxiliary system of licensing mechanism.
