The emergence and rise of online ride-hailing vehicles(abbreviated as online vehicles)have tremendously facilitated the travel to the public and greatly improved the using efficiency of motor vehicles.However,the social problems and legal conflicts triggered by it cannot be ignored,which has posed great challenge upon the traditional regulatory pattern and regulatory method.With the impulsion of capitals,the online ride-hailing quickly occupied major cities in China.Due to the detective legal system of relevant laws and regulations,online vehicles have been fallen within the regulatory grey zone since its early stage.To create a regulatory pattern linking tradition with modern tests the intelligence and capability of the government.On July 27,2016,The Tentative Measures for the Administration of Online Ride Hailing Services(hereinafter referred to as the Tentative Measures)was formally issued,which has preliminarily formed the overall framework of government regulation on online ride-hailing services and also initiated a new modality of our law-based government in the “Internet+”era.There is a necessity of government regulation for the general characteristics of online vehicles as taxis.Nevertheless,owing to the fact that government regulators who are accustomed to using the approach of administrative examination and approval instead of market supervision for a long term have not given enough consideration for the new developmental characteristics of online vehicles,contributes to the formation of a management style "Depend approval,Light examination".The new policy seems to be a sort of misfit during its actual landing process,and it has not attained expected governance effects in the subsequent actual regulatory process.Blind prohibition for a new ecological model is not beneficial for the innovation of sharing economy like online vehicles;complete emancipation for a new ecological model is not beneficial for the protection of consumers' rights.How to seek for equilibrium between innovation and safety has become an unavoidable real problem for the supervision department.This dissertation focuses on the regulation of online vehicles.Based on the representative theory of government regulations in existence,this paper researches on how the government balances the relationships between the government,the market,and the public and apply collaborative governance when the three have a conflict of interest.It carries on research about the regulation of online vehicles from three aspects.The first aspect is the current situation of online vehicles.It analyzes the necessity of government regulation by comparing the similarities and differences between the online vehicles and the traditional taxis.The second aspect sets Tentative Measures for the Management and Management of Online Ride Hailing Servicese in Guangzhou(hereinafter referred to as the Tentative Measures in Guangzhou)as sample,and analyzes some common problems in the current regulatory pattern of online vehicles through the field research in Guangzhou.The third aspect discusses about how does the government further changes its regulatory thinking in the Internet era,puts forward the corresponding solutions according to the causes of the problems,creates a fair and orderly market environment while upholding public interests,and proposes optimized measures so as to provide inspiration for the administration department.
