Research On Sports Administrative Punishment System

The standardization and legalization of sports administrative punishment is an important way to strengthen the sports law enforcement system and capacity building,and to construct the supervision and management system of the combination of government supervision,industry self-discipline and social supervision.it is the objective need to ensure the orderly,healthy,efficient and coordinated development of sports in the new era.However,there is no systematic theoretical research on how to realize the standardization and legalization of sports administrative punishment in our country.Therefore,it is of great theoretical and practical significance to systematically study the system of sports administrative punishment and provide theoretical guidance for the standardization and legalization of administrative punishment.On the basis of analysing the existing theories of administrative punishment concepts such as the theory of domain,the theory of performance and the theory of way and fully absorbing the reasonable factors of them and combining with the practice of sports administrative punishment in our country,this paper makes a scientific definition of the connotation of sports administrative punishment that sports administrative punishment is the administrative punishment carried out by sports administrative agencies and sports social organizations in order to maintain the order of sports administration Sports administrative punishment includes government sports administrative punishment and association sports administrative punishment,which complement each other in their respective duties and fields.On this basis,centering on the system composition of sports administrative punishment,this paper analyzes and studies the problems existing in the setting of sports administrative punishment,such as the imperfect setting of administrative punishment for high-risk sports,the lack of legal basis for the setting of administrative punishment for domestic associations,and the defects in the effectiveness of the setting of punishment by international sports organizations.In the aspect of implementation,there are some problems,such as the deviation in the understanding of the law enforcement subject status of sports administrative agencies,the lack of regulation of the discretionary power of the association sports administrative punishment oegans and so on.In the aspect of relief,there are some problems,such as the lack of relief procedure of association sports administrative punishment,the absence of national relief of association sports administrative punishment and so on.In order to realize the standardization and legalization of sports administrative punishment,we should further improve the setting system of sports administrative punishment,perfect the setting of administrative punishment of high-risk sports,and speed up the legislation of administrative punishment in the new field of sports.We shall provide a basis for the setting of association sports administrative punishment for through national legislation;We must improve the implementation system of sports administrative punishment,change the inherent understanding of the,law enforcement subject status of sports administrative agencies and strengthen the construction of the law enforcement team of government sports administrative punishment,establish and improve the discretion benchmark system of association sports administrative punishment.and further improve the rule construction of the hearing system.It is also neccesary to optimize the relief system of sports administrative punishment,improve the relief procedure of sports administrative punishment,and build a diversified supervision and relief system.
