The Predicament And Perfection Of The System Of Receiving And Reeducation In China

The admission and correction system is a measure of the education and correction for juvenile offenders in China,which established in accordance with the Article 17(4)of China's Criminal Law.It has a positive significance in preventing and reducing juvenile delinquency.However,there are still many shortcomings,such as vague legal attributes,unclear application conditions,administrative decision-making procedures,single and alienated execution methods,lack of professionals and so on.These defects seriously affect the performance of its functions.By examining the corrective measures for juvenile delinquency education in representative countries such as the United States,Britain,Germany,and Japan,this article uses a comparative research method and uses Li Tianyi's series of cases as the starting point.The purpose is to provide useful reference for the improvement of China's asylum education system.Therefore,China should use the advanced foreign experience as a basis to reforming and improving China's system of admission and correction from the three aspects of physical norms,procedural systems and enforcement systems.The first is to formulate the Law for the Rehabilitation of Minors,which clarifies the legal attributes and applicable conditions of admission and correction system.the second is to carry out judicial reform of the decision procedure to protect the rights of the parties.The third is to improve the implementation method and combine open education with closed education,encourage reeducation institutions and social agencies convergence to form a diversified,multi-level model of accommodation and education.At the same time,cultivate professional talents with comprehensive knowledge to provide the necessary talent guarantee for the admission and correction system.
