Study On The Recording Review Of Local Government Regulations

Local government regulations are the innovation of the exercise of China's formulation power,shouldering the mission of protecting people's rights and interests and developing local economy.We have also been on the road to practice scientific legislation,the role of "supervision",the 2017 Standing Committee of the 12th National People's Congress,so that "record review"has become the focus of each year.However,throughout the filing review system,the local government regulation filing review system has become a weak point of the system.To solve the problems of the system itself as a starting point,to give its content and procedures a new vitality.The core of the local government regulation filing review system lies in two procedures,namely,the filing procedure and the review procedure.Local government regulations are established,drafted,reviewed,decided,and then published.For a period of time after publication,the principal of the local government regulations shall submit the record to the relevant departments,which is the filing procedure.The more important procedure in the local government regulation filing review system is the examination procedure,which is more professional than the filing procedure.The system of record-keeping and examination of local government regulations is to prevent the abuse of local government's legislative power,and in order to maintain the unity of the legal system,it has become an inherent requirement to perfect socialism with Chinese characteristics.By analyzing the contents,procedures and standards of the local government regulation spending examination system in China,we can find that the system is not in conformity with the existing development process,and that it is still a long way from the public's expectation of ruling the country by law,and there are still some aspects to be perfected in the initiation mechanism,examination procedure and supervision results of local government regulations.To this end,the establishment of an effective linkage mechanism,the National People's Congress and the relevant government entities in the review process will be the record review of the information to the other side,to achieve information sharing between the subjects of the review.It is also an important task to refine the standard of record examination of local government regulations,and adhere to the principle of legality and rationality.Efforts should be made to improve the capacity-building of the filing examination and realize the informationization of the record-keeping examination of local government regulations.To improve the system of filing and review of local government regulations,we should not only eliminate the parts that conflict with other legislation,but also try to sum up the experience that can be popularized,so as to make the local government regulation sfile review system more complete.
