A Study On The Flexible Employment Injury Insurance Of Internet Platform

China's unique economic system and the rise of the Internet sharing economy,co upled with the regional imbalance of economic development and the dual econo mic structure,have led to a rapid increase in the number of flexible employment on the Internet platform.However,China's current "Industrial injury Insurance r egulations" and "Social Insurance Law" do not include flexible employees in the scope of industrial injury insurance.The flexible forms of employment on the I nternet platform are diversified,and the ways of work are diversified,and the oc currence of work-related injuries is also increasing.Although there is no labor c ontract between the two,there is still a relationship between labor service and th e fee.They should enjoy the same industrial injury insurance treatment as traditi onal workers.This paper locates and classifies the working environment and wor king methods of flexible employees on the Internet platform,and makes a detail ed analysis on the subject of insurance,premium payment and industrial injury tr eatment so as to improve the current industrial injury insurance system.This paper mainly includes the following four core parts:The first part specifically expounds the basic connotation of industrial injury insu rance for flexible employees on the Internet platform,and according to the defini tion of flexible employment on the Internet platform,extends the particularity of industrial injury insurance and the necessity of industrial injury insurance,and makes a theoretical premise analysis for this group to join the industrial injury i nsurance system.The second part mainly introduces the industrial injury insuranc e system and experience evaluation of flexible employees abroad,including the i ndustrial injury insurance systems of France,Germany,Japan and Switzerland,an d dig deep into the industrial injury insurance regulations of flexible employees on the Internet platforms of various countries.draw on the advantages;the empir ical analysis mainly includes three aspects: the insurance scope of flexible emplo yees,the identification of the main body of payment and the treatment of indust rial injury insurance.The third part describes the current situation and deficiency of the industrial injury insurance for flexible employees on the Internet platform in China,and finds some merits by analyzing the industrial injury insurance sys tem for flexible employees in Nantong,Taicang,Weifang and other pilot areas.such as allowing flexible employees to participate in insurance alone;At the sam e time,there are also some shortcomings,such as more restrictions on the insure d,the identification of industrial injuries is not comprehensive and the treatment of industrial injury insurance for flexible employees is low and so on.On the b asis of the previous three parts,the fourth part puts forward legal suggestions fo r improving industrial injury insurance for flexible employees on the Internet plat form in China.Special industrial injury insurance provisions should be formulate d according to the particularity of the work of such groups,instead of being dir ectly incorporated into the current industrial injury insurance system,which mainl y includes three aspects: the classified insurance policy for flexible employment on the Internet platform,the industrial injury identification system and the treatm ent of industrial injury insurance.In order to effectively protect the rights and in terests of workers who are flexible in employment on the Internet platform.
