Research On China's Motor Vehicle Insurance Fraud And Its Countermeasures

As a kind of risk protection,motor vehicle insurance also has certain risks.As the market share of motor vehicle insurance continues to rise,the risk of motor vehicle insurance fraud continues to increase,and it has gradually become a serious area of insurance fraud.Motor vehicle insurance fraud infringe the economic interests of insurance companies,damage the legitimate rights and interests of other policyholders,and hinder the healthy development of the entire insurance industry and the smooth operation of China's market economy order.The crime of motor vehicle insurance fraud is not only a stubborn illness in the insurance industry,but also a livelihood and social problem.It has important theoretical and practical significance to study it.From the perspective of criminology,this paper summarizes the current situation of motor vehicle insurance fraud in China with the help of statistical analysis of cases and data;analyzes various causes of motor vehicle insurance fraud by using multi-disciplinary theory and research methods,explores the internal logic of motor vehicle insurance fraud;Based on the successful experience of other countries,this paper puts forward some suggestions for the prevention and control of motor vehicle insurance fraud in China.This paper is divided into four parts:The first part is the concept definition.Define related concepts such as insurance fraud,motor vehicle and motor vehicle insurance,motor vehicle insurance fraud,etc.The second part summarizes the current situation of the crime of vehicle insurance fraud in China.This part is based on the official data released by the National Bureau of Statistics and other agencies,as well as the collected 1217 cases from 2014 to 2019 as a support,summarizing the overall situation,crime characteristics,and main types of China's motor vehicle insurance fraud.The third part analyzes the reasons of China's motor vehicle insurance fraud.Analyze the causes of crime from the perspective of individual offenders,market environment,laws and regulations,insurance companies;With the help of the theories of economics,Criminology and psychology,such as rational person theory,cost-benefit analysis,information asymmetry theory,moral hazard theory,to analyze the causes of crime.The fourth part puts forward the prevention and control measures of motor vehicle insurance fraud.Based on the analysis of the current situation and causes of crime,and drawing on the advanced experience of the United States,Britain and other developed countries,this paper puts forward targeted prevention and control measures.By using theprinciple of maximum honesty,incomplete contract theory and strengthening theory,the paper puts forward the prevention and control countermeasures from the aspects of standardizing automobile insurance market,improving laws and regulations,strengthening the fight against crime,optimizing internal control,empowering with big data technology,and strengthening individual education.
