With the rapid development of network technology,the sharing economy uses the Internet to integrate traditional industries,creating a new "platform + individual" employment model and spawning a large number of online contract workers.As a new type of non-standard labor relationship,the employment relationship of online contract workers is more novel in form than the standard labor relationship,and the work place is more flexible.This employment method brings great convenience,so many people choose to join the network of contract workers,setting off a strong employment trend.Technological innovation provides a large number of employment opportunities for practitioners.However,the complexity of the employment relationship makes it difficult to determine the labor relationship in theory and judicial practice,and it also has a negative impact on the labor rights protection of online workers.There are many problems in China's labor legislation,such as outdated laws and regulations,lack of standards for determining non-standard labor relations,and inadequate labor security measures.In judicial practice,when determining whether an online contract worker has a labor relationship,the court finds that it is relatively negative,the rules are confusing,and the judgment standards in different places are different.Although employment methods are constantly innovating and the number of online contract workers is constantly expanding,many problems have arisen because of this.At present,it is urgent to solve the problem of labor rights protection of contract workers.This article adopts methods mainly including case analysis and comparative analysis,etc.,to study the relevant legal issues of the labor rights protection of China's online contract workers.The article points out the difficulties encountered by China's online contract workers in determining employment relationships and protecting labor rights.By drawing on foreign experience and related systems,specific suggestions are made for the improvement of the labor rights protection system for China 's online contract workers.
