With the development of Internet,e-commerce market has become an important part of economic market.At the same time,a new type of economic illegal behavior——Click farming,has seriously affected the sustainable development of China’s e-commerce industry.The reason why the phenomenon of Click farming in e-commerce market is more and more intense is that the evaluation of online goods will have a significant impact on the behavior of consumers,and as a means of publicity,the cost of single brushing is low and the effect of drainage is significant.Through literature research,the author collected and analyzed the relevant research results and data in the academic circle,and believed that the manifestation of the Click farming is various,involving various legal relationships.In essence,it is the common false behavior of operators and false purchasers in the online trading market to cover up illegal purposes,which can be divided into "False good comments","malicious bad comments" and "reverse single swiping".Through comparative analysis,the author gets the conclusion that economic law can effectively protect the infringed and healthy development of e-commerce market.However,from the current situation of China’s economic law regulation,we can see that there are still some deficiencies,such as the slow development of relevant legal systems,the unclear subject of responsibility,the obstacles of victims’ claims and the lack of prevention in advance.Therefore,based on the actual situation of our country and referring to the relevant research at home and abroad,the author puts forward the following suggestions on how to realize the effective regulation of the Click farming in China’s economic law:At the legislative level,first of all,we should make clear the four responsibility subjects of the merchants,the subjects who provide the service of Click farming,the network trading platform and the logistics operators,and reasonably divide the responsibilities.Secondly,we should improve the existing laws and regulations,build a three-dimensional industry legal system,and provide legal protection for the development of e-commerce industry.In the aspect of law enforcement,the main bodyof law enforcement should be defined and the power of law enforcement should be unified;the illegal cost of the person who Click farming can be increased through tax regulation and control,and the false transaction based on the Click farming can be strictly taxed to improve the administrative efficiency;the network regulatory agency can accurately and effectively crack down on the person who Click farming by improving the supervision system of the network transaction market.At the level of platform governance,the author suggests that e-commerce platform can use personal credit system to check the merchants who Click farming;reduce the enthusiasm of merchants to Click farming by improving the credit evaluation system;earnestly perform the obligation of information publicity,so that consumers have full right to know.On the whole,this paper studies the current situation of the regulation of the Click farming in the economic law,so as to put forward targeted suggestions,in order to better use the economic law to restructure the e-commerce market and maintain the economic order of the network market.
