Research On The Public Lending Right System Of Digital Books In China

The public lending right system has a history of several decades since its creation.The original intention of the system is to better protect the economic interests of copyright owners.The early public lending right system was built on the paper book carrier,but with the rapid development of digital technology and Internet technology,digital books began to emerge continuously,which made it possible for people to contact and obtain other people's works at a very low cost.On the one hand,the rise of digital books brings great convenience for people to read and use works,but on the other hand,it has many adverse effects on the protection of the interests of copyright owners.In order to balance the interest relationship between copyright owners and the public,it is necessary to extend the traditional public lending right system to digital books.As China has not yet established the public lending right system,it is of great significance to introduce the system in the field of digital books.The research on the public lending right system of digital books has just started in China,and many issues have not reached a consensus.Therefore,it is of great theoretical and practical significance to strengthen the research on this issue.This paper first defines the legal nature of public lending right and the basic concept of digital books,and analyzes the relationship between public lending right and the right of information network dissemination,right of rent and right of fair use.Secondly,it discusses the necessity and feasibility of establishing the public lending right system of digital books in China.Taking the continental law system and Anglo-American law system as the dividing standard,this paper introduces the legislation mode,subject,object,management organization,compensation and other contents of the public lending right system of the two countries in detail,and summarizes the enlightenment of relevant systems outside China to the system construction of our country.Finally is to how to build digital library public lending right system in China,mainly should be strictly defined,the applicable scope of the digital library of public lending right system to clarify the nature of the digital library public lending right,management institutions,such as the subjects of rights,obligations,rights object system elements,and the digital books embodied the compensation system design of public lending right.
