Research On China’s Personal Information Classification System

At present,the protection of personal information in our country is facing great challenges.Personal information infringement cases occur from time to time.Some relevant laws and regulations about personal information protection are contradictory.The fundamental reason of these situations is that the lack of personal information classification system.However,the conclusions about the concept,system attributes and classification methods of the classification of personal information have not be defined.Existing research believes that civil law is actually the basis for personal information protection.The definition and classification of personal information by civil law are the cornerstones for other departmental laws to better regulate personal information and punish personal information infringement crimes.At the same time,it is also conducive for civil law itself to effective and orderly blame for infringement of citizens’ personal information.Therefore,the research on the classification system of personal information is particularly important.The first part is the introduction,which introduces the background,significance,innovative points,research methods and ideas,and research status of the topic selected in this article.The second part is the basic definition of personal information classification,including the definition of personal information,historical development,standardized performance,characteristics and the definition of personal information classification.This part establishes the research object of this article and deeply explore the personal information.The third part is the research on the attributes of personal information grading system in China.This part clarify the legal attributes of personal information grading system and comb the practice of personal information grading system.Then provide a theoretical and practical basis for the subsequent selection of personal information grading methods.It also further clarify the relationship between the personal information classification system and the relevant department laws,as well as clarify the status of China’s personal information classification system in the legal system.The fourth part analyzes the necessity of the construction of personal information grading system from four parts: national security,legislative unification,judicial practice,and information circulation.Besides,the feasibility of establish the personal information grading system has been discussed from the internal structure of personal information,system system design,and practical practice.The fifth part is the reference of foreign legislative experience.The experiences in the United Kingdom,Germany and the United States are mainly presented.The sixth part is the suggestion of constructing Chinese personal information classification system.The principles and methods of personal information classification system and the necessary legal norms for the system construction are involved.Further,this part has proposed specific legal suggestions about the construction and infringement punishment of personal information classification system from the aspects of legislative norms,judicial practice,and the matching of related systems.As a result,more suggestions for the construction of China’s personal information classification system and the relevant provisions of the Civil Code on personal information could be provided.More importantly,the construction of personal information classification system will improve the legal system of personal information protection in China,solve the current judicial dilemma,safeguard the legitimate rights and interests of citizens’ personal information,and ensure the security of information in China.
