On Minor Victims Investigation Interview

In recent years,the types of criminal cases in which minors have been violated have been diversified.Minor victims,as important participants in criminal procedure,have special position according to laws.The inadaptive treatments are more likely to cause secondary injuries after crime.In current investigation interview,police often treat the minor victims as adult victims.There are limitations in minors' cognitive abilities and expressing abilities,the police should pay more attention to the methods and strategies of interview.The author combined theoretical study and data analysis,summarized her own public security practice experience,explore the minor victims investigation interview,and puts forward the procedures and techniques of this kind of interview,makes constructive suggestions about the mechanism of minor victims investigation interview.This dissertation consists of the following seven parts.The first part is an overview of the concept,content and meaning of the investigation interview,introduces the regulations about the rights and interests of minors and the legal requirements for minor victims investigation interview;The second part includes the characteristics of minor victims investigation interview,the conative characteristics of minor victims from the psychology,basic characteristics of investigation interview.The author expresses the emotional and behavioral characteristics of the minor victim during the interview;The third part is based on the data of criminal cases include minor victims which handled by the public security organs in Y District of City B.The author analyzes the current situation of minor victims' investigation interview,and proposes the deficiencies in the practice of this kind of interview,comprises the method of interview,and the interviewers and the implement of interview;The fourth part combines the second and third parts with the guiding principles for minor victim investigation interview,which are the principles that need to be followed throughout the interview;The fifth part is about the procedures for minor victims investigation interview,including preparations,engage,asking adaptive questions,records,closure and evaluation,feedback;The sixth part focuses on the techniques minor victims investigation interview.These techniques comprises arranging the environment and furnishings,assisting personnel,engaging skills,using specific equipment,analyzing body languages and guiding the interviewees' emotions.All of these techniques can improve the effectiveness of investigation interview;The seventh part is to construct and improve the mechanisms for minor victim investigation interview.The author draws on the excellent practices of some public security organs,and proposes four basic contents of the mechanism.The mechanism will do help in achieving the purpose of law and protecting minor victims in investigation.
