Research On The Countermeasures For The Investigation And Prevention Of The Crime Of Deforestation

In recent years,with the rapid development of social economy,the demand of various indu stries for wood is growing day by day.At the same time,the crime of logging for the purpose of obtaining timber is also frequent.Among them,the crime of deforestation is the most common type,which accounts for a large proportion in the crime of deforestation and has a serious harm to forest resources.This paper takes the crime of deforestation as the research object,mainly using the methods of literature research and empirical research,starting from the overview of the crime of deforestation,analyzes and summarizes its causes,means and characteristics of crime,and then puts forward the investigation and prevention countermeasures,which can provide some reference for the effective maintenance of social management order and the protection of forest resources in theory and practice.This paper is divided into six parts:The first is the introduction,which introduces the purpose,significance,current situation and methods of this study.The second is the overview of the crime of deforestation,including the meaning of deforestation,the concept of the crime of deforestation and the identification of the crime of deforestation.Taking the sample cities as an example,this paper analyzes the current situation of the crime of deforestation in five years from 2012 to 2016.Third,the causes of the crime of deforestation are analyzed from the aspects of social causes,crime subjects and management subjects.The fourth is the means and characteristics of the crime of deforestation;taking the sample city as an example,this paper analyzes the means of the crime of deforestation in practice,and sums up the characteristics of the crime of deforestation in terms of the time,place,subject,motive,tools and quantity of deforestation.Fifthly,the investigation countermeasures of the crime of deforestation are put forward from the aspects of strengthening the position control to collect information clues,determining the criminal suspects,evaluating the degree of confrontation between the criminal suspects,flexibly using the investigation strategy,paying attention to the collection of criminal evidence such as trace evidence and accurately identifying the number of deforestation.Sixthly,the prevention countermeasures of the crime cases of deforestation are put forward from the aspects of improving the public awareness,the combination of blocking and thinning,strengthening the grass-roots management and grass-roots law enforcement,and improving the legal settings and application.
