Research On Legal System Of Mining Land Under The Background Of Rural Land Reform

Mineral resources are the precious wealth endowed by nature and the basic guarantee for human survival and social stability,progress and development.As the largest developing country in the world,the mining industry is a typical pillar industry,which plays an extremely important role and practical significance in China's energy consumption,economic development,mining market stability,strengthening foreign mining trade cooperation,etc,and it is also an embodiment of the country's comprehensive strength.In recent years,mineral resources have played an important role in the process of industrialization and rapid development of national economy.However,with the gradual increase of the demand for mineral resources in the social development,its guarantee role in economic construction,production and life is severely challenged.Throughout the relevant laws and regulations of mining industry in China,the definition,term of use,method of acquisition,reclamation and withdrawal of mining land are relatively vague.Most of them directly refer to general provisions on construction land,but lack specific,specific and normative provisions.The legal basis of the acquisition procedure of mining land is not clear,the management mechanism of mining land is not perfect,the disputes between mining right and land use right occur frequently in practice,the interests of all parties are out of balance,and the contradiction is increasingly acute.What's the problem? Why?How to perfect the mining land system from the legal level?
