A Study On The Settlement Of Disputes Over The Fees Of Rural Matchers

With the development of a society ruled by law,the concept of rule of law has gradually taken root in the hearts of the people.The number of cases concerning matchmaker fees in China's judicial practice is also increasing year by year.Due to large differences in regions,economy and the amount of cases,judges have different standards and criteria for judging such cases,and the results of the trial are also very different.This article starts with three cases with similar cases and different trial results in three different regions,and shows three views on the nature of matchmaker fees in judicial practice.In order to further study the differences in the trial of cases related to matchmaker fees in rural areas,the author has comprehensively screened relevant cases through relevant websites such as China's Judicial Documents Network,OpenLaw and Non-litigation Network,and has counted 88 judicial documents related to disputes over matchmaker fees.The trial of matchmaker fees in judicial practice is reflected through four aspects: year,cause of case,trial basis and region.Secondly,it introduces and analyzes the three viewpoints of the matchmaker fee,including the three viewpoints on the nature of the matchmaker fee,the theoretical basis of each of the three viewpoints,the trial made by the judge according to the three viewpoints,and the shortcomings of each of the three viewpoints.Finally,after a comprehensive comparison of the three viewpoints,the author puts forward his own opinions on the nature of the matchmaker fee,which the author believes can be consulted when dealing with disputes over the matchmaker fee.
