As the housing price continually increases,the public rental housing can effectively alleviate housing problem.According to the lack of state constructional land,Ministry of Land and Resources approved that Beijing and Shanghai became the first pilot cities of building public rental house in collective constructional land in 2012.Later on,Ministry of Land and Resources issued related documents in August 2017,totally 13 cities became polite cities,such as Beijing,Shanghai,Nanjing,Hangzhou,and etc.Under the polite project,rustic economic organization is allowed to engage in public rental housing even independently or jointly.Up to January of 2019,there are totally 18 polite cities.It is active to build public rental house in collective constructional land.On one hand,it can improve farmer's income by increasing the usage rate of rural land;on the other hand,it enhances land source of public rental housing,and effectively alleviates housing problem.However,according to Chinese legislation,the transaction of collective land in the market is illegal except the 33 polite cities before Jan 1st 2020.Even though in the polite cities,market-oriented collective land is only allowed to be used as operational land,such as manufacture and commercial use;real estate development is not allowed.This policy will keep the same after Jan 1st 2020.Therefore,there is a lot of legal impediment of building public rental house in collective constructional land.The following report describes the innovation history of public housing system and marketization of collective constructional land system.Then,author compares the first two polite cities,Beijing and Shanghai,based on related polices and real cases.According to the theoretical research and case study,author summarizes the legal impediment of land supply in such system.For example,the title of the real estate and collective constructional land is unclear;the use of collective constructional land does not follow required policy.Based on above research and legal impediment,author offers related proposal to improve the system.
