Since 2009,when the work report of the state council have proposed for the first time that “Develop public rental housing vigorously”.There have issued about local government regulations or normative documents of public rental housing in many cities in our country.It has always been constantly perfected.Because of the lack of uniform housing legislation and related regulations,some questions came out in the process of implement.Behind these problems are reflecting the lack of related laws in our country.The author comes up with some problems and insufficiency about public rental housing system on the basis of the relevant policy in our country.And she want to find some valuable reference to develop public rental housing in China by reference to the countries who have built public housing system for a long time with more mature experience.In this paper,the main content includes the following 4 parts:The first chapter is about the overview of public rental housing system.Firstly it studies the concept of public rental housing.There are diverse kinds of concepts about public rental housing.Then it tells the legal basis of public rental housing,from the perspective of economic law and social law.In the final it analyzes the public rental housing system of affordable housing policy choice in China's comparative advantage.The second chapter is the analysis of the legislation and problems now.It is mainly based on the implementation of public rental housing system in China with the overall and several major cities such as Xiamen and Nanjing.The author summarizes the public rental system with some relevant provisions of the laws,regulations and policy and puts forward the difficulties in the public rental housing system in our country.The main difficulties exist the following 4 problems:1,the low legislation level with the system of public rental housing;2,incomplete public rental housing operating system;3,unreasonable rent setting standard;4,lack of regulatory system for regulatory system.The third chapter is the summary and reference of the advanced public housing system in several countries.The author studies legal public rental housing system in America and Singapore.Both America and Singapore has perfect housing legislation.Especially tax policy on public rental housing finance has a positive effect in America,while strict access and punishment mechanism also in Singapore is worth for reference in our country.Their public rental housing operation model is both market-oriented.On the basis of our country`s condition and tradition,the author concludes that we should improve the relevant legislation and the developing trend of public rental housing policy is marketization.The fourth chapter is the key chapter in this article with the summary and conclusion of the above chapters.The author puts forward some suggestions for reference.There are including 3 aspects:1,improve the legislation level of public rental housing system;2,improve the legal system of public rental housing for market-based,including improving the law system for construction and operation of public rental housing,establishing a housing subsidy system to address the problem of rent setting,and improving the supervision system of public rental housing marketization.
