| In recent years,the crime of online molestation of children in China has been on the rise,and the public security organs,people's procuratorates and people's courts have been investigating and handling more and more such cases,which shows the seriousness of this kind of crime.Due to immature physical and psychological development,children have little knowledge of sex,insufficient sex education,weak awareness of sex safety and sexual prevention,and insufficient identification of network information,they are easily violated by criminals.Moreover,Internet molestation has caused serious trauma and impact on children's physiology and psychology,hindering children's healthy growth and seriously infringing on children's legal rights and interests.Through the network of crime of child molestation of judicial cases,the victim and criminal summary of basic data,this paper uses EXCEL statistics software to carry on the analysis,summarizes network obscene crime pattern,explore the connection between the offender and the victim,Finally,the author puts forward feasible prevention and control suggestions on preventing children molestation online.This paper is divided into three parts.The first part is the definition of the network molestation of children.This part mainly introduces the following contents: firstly,from the perspective of criminal law,it introduces the indecent ACTS of traditional indecent crimes against children and the role of the Internet in indecent crimes against children.Combined with the above analysis,it summarizes the concept of online indecent ACTS against children.Secondly,on the basis of concept,the author classifies the crime from the perspectives of crime motive,crime means and crime space.Finally,combining 28 cases,the paper focuses on analyzing the quantity change and regional distribution of the cases,as well as the basic characteristics of criminals and victims.The second part analyzes the causes of the crime of Internet molestation of children.The criminal with criminal motive,the victim without experience and lack of judgment ability,the guardian without guardianship and the network platform all contribute to the crime.To investigate the reasons for the behavior of child molestation offenders on the Internet,one is that the criminals pursue sexual stimulation by hook or by hook.Second,the criminal lacks the sympathy,the control crime occurrence selfregulation ability reduces greatly.Third,the criminal belittles the legal order,mainly in the process of their growth when they adapt to the environment and environmental interaction problems.Children's vulnerability is mainly determined by their physical and mental characteristics.On the one hand,children are physically and mentally weaker than adults.In cyberspace,the victimization of children is greatly enhanced when offenders find it easy to commit obscenity and are not easily detected.On the other hand,children's vulnerability is also related to their poor sense of self-defense and bad living habits.In addition to the criminal,the victim of the factors are known as the "third party factors",mainly including the victims as the guardian of the parents and schools,as well as the crime as the place of the network platform.The third part is to the network molestation of children crime put forward feasible countermeasures.There are mainly three levels.Primary prevention targets an unspecified target,suppresses all potential offenders,and affects all populations,including legal deterrence and educational prevention.Secondary prevention refers to specific elements of crime occurrence,such as high incidence of crime groups,hot spots of crime,high incidence of crime,etc.,mainly refers to strengthening network supervision and creating a good network environment.The measures adopted by the tertiary prevention strategy to prevent criminals from reoffending mainly include special deterrence,deprivation of criminal capacity and other corrective measures.The most important thing is to correct the offender. |
