Research On Government Regulation Model Of Webcast Platform

Webcast is the rapid rise of Internet star industry based on the development of Internet technology in recent years.The Regulations on the Administration of Internet Live Services define webcast as an “Internet-based activity for the continuous dissemination of real-time information to the public in the form of video,audio,graphics and text ”.The rise of webcast not only changed people's traditional entertainment and social ways,but also led to the prosperity of the Internet economy.But at the same time,the attribute of the emerging industry means that the regulation mechanism is not perfect,and the webcast platform has also become a serious disaster area for illegal and bad information breeding,which has a great adverse impact on the society.In the second half of 2016,a series of regulatory policies were introduced,and various departments carried out special governance actions one after another to focus on rectifying the webcast industry.In a short period of time,the regulation of webcast platform presents a high-pressure situation.However,with the continuous increase of relevant legislative documents and the frequent special governance actions,the negative events of webcast platform are still happening,which fully shows the imperfect regulation of webcast platform by the government at this stage.Therefore,in the transition period of the state regulation system,the study of the current network broadcast platform government regulation model,to improve the government regulation model,guide the network broadcast industry benign development.It makessense.The paper consists of five parts: in the first part,it mainly explains the basic information such as the research background and the significance of the topic,the research status at home and abroad,the research contents and methods,the innovation and shortcomings.In the second part,firstly,the concepts of webcast platform and regulation mode are clarified.Then,the theoretical basis of this study,namely the main content and specific methods of the responsive regulation theory,is discussed,and its applicability is analyzed.In the third part,the main problems of webcast platforms are summarized at first,and then the basic situation of the regulation mode of webcast platforms is sorted out from three aspects: the relevant legal basis,the setting up of regulatory authorities and the main regulation measures.In the fourth part,through the first three live online platform regulation analysis of typical cases,and on this basis to discuss the current broadcast network platform defects of the government single regulation model,mainly including government regulation means a single,regulatory policy exists subjectivity,department regulation range overlapping,live online platform lack responsibility consciousness and the industry association is limited etc.;Furthermore,it further analyzes the causes of the defects,including outdated regulatory concepts,backward legal system construction,lack of coordination and cooperation between departments,unequal rights and responsibilities between the platform and the government,and backward development of industry associations.In the last part,the author combined with responsive regulation theory,put forward the network broadcast platform cooperative regulatory model,to achieve the government and the webcast platforms,industry associations,the public and the media such as full cooperation between regulatory agencies,from the transformation regulation concept,strengthening the construction of the government,and shape the subjective consciousness and the establishment of cooperative mechanism four aspects of present regulatory model optimization Suggestions were put forward,so as to gradually realize the transformation of government single regulatory model to cooperative regulation model of webcast platform.
