A Study On The Copyright Infringement Of Songs Performed On Webcast Platforms

The iteration and progress of Internet technology has provided support for the rise and rapid expansion of webcast industry.In 2016,webcast quickly entered the public field of view and became a major focus of public attention.The live broadcasting platform of the network presents the blowout type growth.Up to now,according to relevant data shows,there are nearly 300 webcast platforms in China,covering various fields,the number of the main broadcasting of the network reaches more than half a million,the live broadcasting audience is more than 400 million people,the development of the live broadcast industry of the network has great potential.Relying on the continuous progress of Internet technology,and its operation mode and marketoriented operation,the webcast platform has gained the support of commercial capital and audience market,showing huge profit space and commercial value.At the same time,due to the lagging development of the law,the lack of industry norms,and the lack of supervision and other reasons,leading to the rapid and disorderly "barbarous growth" of the webcast platform,it brings a series of legal problems and regulatory problems such as vulgar content,intellectual property infringement,privacy infringement and so on.For the sake of the sustainable,standardized and prosperous development of China’s cultural industry,as well as the orderly and healthy development of the webcast industry,it is necessary to regulate the chaos of the webcast platform and strengthen the supervision and control measures of the webcast platform.Industry and academia began to pay attention to this hot topic.This paper will focus on the phenomenon of singing songs on webcast platform,to research on the copyright infringement of music involved in it,and explore the ideas of supervision on the copyright infringement of music on webcast platform.From the point of view of copyright law,this paper discusses the problems of infringing the copyright of song works,analyzes the nature of copyright infringement involved in singing songs on the webcast platform and the tort liability faced by the webcast platform.This paper analyzes the reasons from the angle of supervision of laws and regulations and platform self-discipline,and draws lessons from the supervision experience of copyright infringement at home and abroad under the network environment.This paper tries to put forward some valuable thoughts and constructive suggestions for the supervision of song copyright infringement on webcast platform.
