Civil Rights Protection In Artificial Intelligence Embedding Government Governance Process

As Xi Jinping,the General Secretary of China's Communist Party said in his congratulatory letter to the 2018 world artificial intelligence conference,China is committed to achieving high-quality development,and the development and application of artificial intelligence will effectively improve the intelligence level of economic and social development,and effectively enhance public service and city management capabilities,the government governance scenarios have become an important part of the application of artificial intelligence.In the process of the modernization of the government's governance capacity assisted by artificial intelligence,some new governance problems have emerged,among which the protection of civil rights should not be underestimated.Artificial intelligence technology enables the government to safeguard civil rights on a broader and deeper level.But the new governance scenarios it creates also challenge the government's ability to protect the rights of its citizens.If the government can effectively guarantee the civil rights in the context of Artificial Intelligence embedding government governance,it will be conducive to the construction of a good relationship between the government and citizens,the prevention of "Tacitus trap",and the building of a government that "satisfies the people".Therefore,paying attention to the protection of civil rights in AI embedding government governance is a forward-looking issue that the public administration discipline needs to respond to in the era of artificial intelligence.This study firstly summarizes the research products of civil rights in China and abroad,and investigates the research contents related to the government governance under the background artificial intelligence.Then,on the basis of the theory of civil rights,the theory of government-citizen relationship and the Marxist theory of technical ethics,the author conducts a normative analysis on the target direction of civil rights protection in AI embedding government governance.Furthermore,this paper analyzes the reality of civil rights protection in AI embedding government governance,including the main application scenarios of AI embedding government governance.The plight of civil rights protection in AI embedding government governance,such as the citizen's privacy being threatened,the function of public security system being overstepped,the construction of intelligent city lacking overall planning,etc.The main reasons for this dilemma are that the artificial governance technology is yet to be mature,the data nature is complicated,the government's technical governance capability is weak,the forward-looking policy design is short,and the gap between citizen technology is obvious.Finally,from the three different levels of government capability,policy optimization and citizen action are proposed as the paths to effectively implementing the protection of citizens' right government capacity.From the perspective of government capability,strengthening the construction of government technology departments,improving the technical governance ability of officials,and constructing the data rights protection system should be realized.From the perspective of policy optimization,improving laws and policies related to data rights,formulating the ethical rules of artificial intelligence,and increasing the budget of academic research should be emphasized.From the perspective of citizen actions,improving the cognition of modern governance technology,learning artificial intelligence technology and application,and actively participating in the policy process should be taken into action.
