In recent years,with the rapid growth of tourism consumption market,tourism has become the most common form of leisure consumption for Chinese citizens.At the same time,the regulation of tourism consumption rights protection is gradually improving.Since the promulgation of the law of the people’s Republic of China on the protection of consumers’ rights and interests in 1993,a total of 32 regulatory documents on the protection of tourism consumption rights have been successively issued and implemented.However,according to the trend of Tourism Quality Supervision published by Shanghai Tourism Administration every month,the amount of invalid rights protection from 2013 to 2018 exceeded the amount of effective rights protection every year.With the increase of invalid complaints,the typical cases of irrational rights protection are also highlighted,such as threats to rights protection by means of media exposure,petition,impact on normal operation,or waste of public resources caused by the same rights protection in multiple ways,or blind rights protection without understanding the scope of legitimate rights and interests.Through literature research,case analysis and statistical analysis,taking Shanghai as an example,this paper summarizes and analyzes the cases of irrational protection of tourism consumption rights under the existing regulations,explores the causes of the phenomenon of irrational protection of tourism consumption rights,andputs forward the optimization route of the regulation of tourism consumption rights,maintains a good atmosphere of rational protection of tourism consumption rights,and promotes a virtuous cycle of tourism consumption market development.This paper is divided into seven parts: the first part is the introduction,the second part is the definition of the concept and the theoretical basis,the third part is the current situation of the regulation of tourism consumption and the irrational rights protection of consumers in Shanghai,the fourth part is the empirical study of the irrational rights protection of tourism consumption in Shanghai--Based on 308 cases of irrational rights protection,the fifth part is the causes of the irrational rights protection of tourism consumers in Shanghai under the existing regulations The sixth part is the optimization route suggestions for these problems.The last part is the conclusion.Qualitative research was used.Compared with the previous research on the behavior of safeguarding tourism consumption rights,this study pays more attention to the causes of irrational consumption rights in the case study,and analyzes the three parties involved in the protection of tourism consumption rights-namely,tourism consumers,tourism operators and government regulatory departments-through the combination of the causes of irrational protection of tourism consumption rights.At the same time,qualitative research can make up for the deficiency of quantitative research,avoid too much data in quantitative research and reduce the connection with the reality.The emergence of the irrational protection of tourism consumers’ rights has caused injustice to the rational protection of tourism consumers,and has a negative impact on the healthy atmosphere of the tourism consumption market.However,the single structure of regulatory institutions is not conducive to the authority,coordination and professionalism of regulatory formulation.In addition,tourism operators are generally lack of enthusiasm and initiative in dealing with cases of tourism consumption rights protection.The current shrinking of the management authority of tourism industry associations in Shanghai and the poor implementation of regulations by the government regulatory authorities are one of the important reasonsfor the endless problems of tourism consumption rights protection.And the inconvenient use of the way of tourism consumption rights protection and relief always exists.These factors together become the cause of irrational protection of tourism consumers’ rights under the existing regulations.This paper further analyzes these factors and puts forward corresponding countermeasures.Improve the guidance of the concept of rights and responsibilities of tourism consumers,increase the propaganda of rational rights protection,and control the irrational rights protection,so as to realize the real public interest of tourism consumption rights protection,and promote the healthy development of tourism consumption market.Through the rational allocation of the power of each regulation and executive agency,and the establishment of a detailed linkage mechanism system,and the introduction of diversified social organizations to participate in regulation,to achieve diversified governance.The establishment of incentive mechanism can reduce the cost of regulation and improve the internal efficiency of regulated enterprises.Enhance the management authority of the tourism industry association,and strengthen the daily supervision ability of the government regulatory authorities.The legal four ways of rights protection and relief are focused on clear division,integration of external channels and specific division of internal talents,so as to improve the convenience of use and reduce the waste of administrative resources.
