Research On The Involvement Of Social Work In The Juvenile Justice System

Since the mid-1980s,juvenile delinquency has gradually become a hot issue of social concern,and it has received widespread attention for juvenile crimes.China has a vast territory and a large population.When the "second child" policy is fully liberalized,the total population of China's juveniles will increase greatly.Some decaying lifestyles such as money worship and hedonism are constantly testing the current juveniles and society.Unfairness abounds everywhere.These are a great test for juveniles who have a weak ability to distinguish between right and wrong,and they are also very unfavorable for the formation of their three views.Many young people can't resist the temptation.They are affected by the bad atmosphere in society and it is extremely easy to embark on the road of illegal crime.Minors have not yet formed the ability to think rationally,logical thinking is not enough,social experience is insufficient,the ability to analyze things and distinguish between right and wrong is not strong,and it is not rational to treat many problems,but only to deal with problems by their own perceptual knowledge..In the past,the main solution to the problem of juveniles was to rely on judicial procedures and criminal law to restrict and restrain them.Because of this,combined with China's judicial resources is relatively limited,it is difficult to take into account the particularities of each sinful teenager when dealing with juvenile cases.As for the juvenile judicial diversion system,it is not perfect now,so that its legal rights are difficult to be guaranteed.It isprecisely because of this,through the introduction of judicial social workers into the juvenile justice system,and the judicial social workers' own professional ability to achieve the protection of juveniles involved.At present,China has not yet formulated a special law on juvenile justice diversion,and the juvenile judicial diversion system has not been established.It is very difficult to intervene in judicial social work.However,through the joint efforts of all parties in the society,the juvenile justice system will be gradually improved,and judicial social work will play an increasingly irreplaceable role.This paper mainly introduces the relevant systems of social work involvement in judicial diversion and related solutions from the following sections.The first chapter mainly introduces the theoretical basis of juvenile justice diversion,including the individualization theory of punishment,children's rights and child protection,Erikson's eight-stage theory and social learning theory.The second chapter mainly introduces the inevitability of judicial social workers involved in the juvenile judicial diversion system,which is introduced from the aspects of judicial social workers and judicial diversion professional and special service needs.The third chapter mainly introduces the diversion of juvenile justice,which mainly includes three stages: investigation stage,prosecutorial prosecution stage and trial stage.The fourth chapter mainly introduces the status quo and problems of judicial diversion,including relevant legal basis,implementation mode and existing problems.The fifth chapter mainly proposes corresponding countermeasures around the problems existing in the fourth chapter.Mainly from the legislative aspect,the intervention of social forces and the role and role of social workers to propose corresponding countermeasures,so as to achieve the purpose of allowing social workers and judicial branches to rely on each other to form a sound judicial diversion system.
