Research On The Responsibility Of Injury Accidents In Physical Education Classes Of Junior High Schools In Yanji City

In recent years,students'injuries,disabilities and even deaths in physical education classes have occurred from time to time,bringing great pain to parents,guardians,schools,students and the whole society.Because our country's laws and regulations on injuries in school physical education are not perfect enough,and there is no perfect handling system and safeguard system in dealing with injuries after the accidents occur,so the disputes between families and schools will follow after the injuries in physical education.Injury accidents not only affect students and their parents,but also affect the normal development of school physical education.In order to avoid injury accidents and reduce responsibility disputes,physical education teachers reduce the sports load of physical education classes in the teaching process to ensure the safety of students.Such a negative response to injury accidents,reduce the content of physical education teaching,resulting in too single content of physical education curriculum,students resist participating in physical activities,so that students can not get physical exercise,and ultimately affect the minor students'grasp of the basic content of physical education and the improvement of various physical qualities.How to reduce disputes in injuries in physical education classes in junior middle schools,ensure the normal development of physical education work in schools,and safeguard the interests of both schools and students,has become an important issue facing our country.In this paper,using the methods of literature,case analysis,expert interviews and logical analysis,from the legal point of view,combined with relevant legal documents,regulations and regulations,and listening to experts'suggestions,the author defines the concept of injuries in physical education classes for junior middle school students,classifies and characteristics of injuries in physical education classes of junior middle schools in Yanji City,and points out the principles of liability stipulated by law in China.In order to reduce the occurrence of injury accidents in the process of physical education teaching' in the future and ensure the smooth development of physical education teaching in schools,the principles of liability attribution adopted in the practice of injury accidents in physical education classes of junior middle schools in Yanji City and the subjects of legal liability for injury accidents in physical education classes of junior middle schools in Yanji City were studied.Through the research on the liability of injuries in physical education classes of junior middle schools in Yanji City,the conclusions are as follows:1.A total of 88 cases of injuries in physical education classes of junior middle schools in Yanji City were collected from 2010 to 2018.According to the degree of injuries,they are mainly minor injuries and minor injuries.According to the nature of injuries,injuries in physical education classes of junior middle schools in Yanji City are mainly abrasions and sprains.The main period of injuries in physical education classes of junior middle schools in Yanji City is the basic period of physical education classes.Part.2.The principle of liability for fault should be applied in the judicial trial of injuries in physical education classes of junior middle schools in Yanji City,but the principle of liability without fault and the principle of fair liability should not be applied.3.According to the principle of fault liability,the main body of legal liability for injuries in physical education classes of junior middle schools in Yanji City is divided into five parts:school responsibility(including all school responsibility and part of school responsibility),student responsibility,family responsibility,third party responsibility and accidental responsibility.
