On The Improvement Of The Scope Of Information Disclosure In Chinese Universities

The definition of the scope of information disclosure in colleges and universities is the core part of the information publicity activities of colleges and universities,and the connotation and extension of the information of colleges and universities is the preexisting knowledge that defines the scope of information disclosure in colleges and universities.The legislative experience of the definition of the scope of information disclosure in some countries outside the region is a useful reference for studying the definition of the scope of information disclosure in China's universities.The paper analyzes the connotation of university information and its legal basis for disclosure,expounds the generality and particularity of the scope of information disclosure in colleges and universities,and introduces the legislative experience of the definition of the scope of information disclosure in colleges and universities.Based on case analysis,this paper analyzes the problems existing in the definition of the scope of information disclosure in China's universities.According to the theoretical knowledge and extraterritorial experience of the scope of university information disclosure,this paper proposes legislative proposals to improve the scope of information disclosure in China's universities.The essential attribute of university information is publicity.The information disclosure of colleges and universities in China has now been incorporated into the track of institutionalization and rule of law.The essential attribute of university information is publicity.The information disclosure of colleges and universities in China has no'w been incorporated into the track of institutionalization and rule of law.At present,the legal norms of information disclosure in China's universities mainly include the Higher Education Law of the People's Republic of China,the Law of the People's Republic of China on the Protection of State Secrets,the Regulations on the Disclosure of Government Information,and the Measures for the Disclosure of Information in Colleges and Universities,and the list of Information Disclosures for Colleges and Universities.From the legislation,the right to know and supervise the employees and teachers of the school and the public are guaranteed.Based on the case study,it is found that there are still some problems in the definition of the scope of information disclosure in China's universities.First of all,the legislative technology that is definitely listed makes the information disclosure of colleges and universities not open;Secondly,the conditions for applying for disclosure are too strict,and the conditions for identity certification are in violation of the upper-level law,which limits the information of colleges and universities according to the scope of application;Finally,the definition of the connotation and scope of state secrets and personal privacy information in the field of colleges and universities is not clear,and the university has given large discretion to disclose information,which makes the definition of university information not open.To a certain extent,the above problems affect the realization of the rights of the right subject to the right to know and the power of supervision.Based on the specific analysis of the scope of information disclosure in colleges and universities,based on the specific analysis of some countries outside the domain,this paper puts forward the idea of further improving the scope of information disclosure in colleges and universities.First,establish the principle of“openness as the principle and non-disclosure as the exception";Secondly,the use of negatively enumerated legislative technical provisions does not disclose the scope,thereby relatively expanding the scope of disclosure;Again,relax the restrictive conditions disclosed in the application.By canceling the conditions of the application for disclosure according to the application,the conditions for the identification of the identity of the application in accordance with the application shall be amended to expand the scope of application according to the application.Finally,the information content and scope of state secrets,personal privacy and university autonomy are clearly defined to strictly define the scope of non-disclosure.This will improve the scope of information disclosure in China's colleges and universities to maximize the protection of the right to know and the right to supervise the rights.
