In order to further normalizing China's labor dispatch,the Ministry of Human Resources and Social Security promulgated the "Interim Provisions on labor dispatch” on March 1,2004.Compared with those former provisions,the act has further defined the position of “tripletcharacters” and set a 10% of employment scale limit in labor dispatch and so on.All these measures have powerfully rectified some illegal behaviors in labor dispatch industry.However,the rule brings a lot of problems,for example,fake outsourcing and real dispatch,equal pay,how we regulate dispatch in government public institutions etc.These problems partly due to the implementation of the rule,or partly because of the rule itself is not perfect.How to overcome these problems exist in practice so that we can effectively regulate market order and protect the rights of workers is still calls for our further study.This paper starts with the promulgation and application of the Interim Provisions,analyses of its effect in practice and points out its corresponding problems.In order to find out some useful experiences,the paper compares to the relevant provisions in the United States,Japan and Taiwan area.Finally,this paper puts forward some recommendations to resolve problems labor dispatch industry exists after the implementation of the rule.
