A Study On The Protection Of Rights And Interests Of Overseas Workers In China Under "Belt And Road"

In recent years,China has successively put forward two great initiatives to build the "Silk Road Economic Belt" and the "21st Century Maritime Silk Road ".More and more countries have responded positively to our call and joined in the construction process of "Belt and Road ".We have always adhered to the purpose of open regional cooperation and the concept of promoting the common development of the world economy,so that the "Belt and Road" initiative has played an important role in efficiently optimizing the allocation of global resources,and countries along the route have jointly constructed an inclusive,balanced and mutually beneficial regional economic cooperation framework.Because many countries along the route have actively joined the construction of "Belt and Road ",the initiative has been fully implemented and constantly made breakthroughs,and the international community has deepened its understanding of the strategy,thus having a profound impact.The cross-border employment of labor force is emerging as a new type of employment mode,and "Belt and Road" provides an important strategic opportunity for China to cooperate with labor services in countries along the route.With the implementation of the "Belt and Road" initiative,China has increased the labor service cooperation business with the countries along the route,and achieved good economic and social benefits,which not only alleviates the domestic employment pressure to a certain extent,drives the local economic development,but also promotes the development of the national economy,solves the dilemma of insufficient or low quality labor force in the countries along the route,and promotes the technological progress and investment prosperity of the labor importing countries.However,with the expansion of the scale of China's foreign labor cooperation year by year,there are more and more foreign labor disputes,the contradictions between overseas workers,employment enterprises and even labor importing countries are becoming more and more obvious.Violations of the rights and interests of overseas workers often occurs,strikes,demonstrations,and even violent incidents occur from time to time.Personal injury and property loss not only bring great pain to overseas workers,but also restrict the smooth progress of overseas investment and contracting projects in China,and even affect the development of "Belt and Road" initiative.Therefore,it is of great practical significance to deeply study the protection of overseas labor rights and interests under thebackground of "Belt and Road ".Therefore,this paper uses three research methods: case analysis,comparative analysis and cross-disciplinary research.On the basis of studying the present situation of labor cooperation in China under "Belt and Road ",and from the point of view of the existing legislation and practice of labor protection,this paper deeply analyzes the problems of diplomatic protection and consular protection,legal conflict and application countries and China's labor protection legislation under " Belt and Road ".In order to protect the legitimate rights and interests of our overseas workers,some suggestions have been put forward to improve the international and domestic legislation to protect the rights and interests of overseas workers,to play the role of diplomatic and consular protection,to coordinate the conflicts of labor laws in various countries and to strengthen the role of the government in resolving labor disputes.
