The Development Trend Of New Technology Patents Of Tea Industry And Its Countermeasures In China

The tea garden area and tea production of China are the largest in the world,tea industry is changing quickly from traditional mode to modern production mode.In the background of fierce competition,the enterprises must strengthen the control of the industrial chain through scientific and technological innovation and grasp the power of the industry.Therefore,it is imperative to put forward the technological progress of tea industry,which is the key to enhance the international competitiveness of China's tea industry.But,the reports about patent application,authorization,protection and application of China's tea industry are fewer than other fields such as food processing.In order to strengthen and promote the technological innovation of tea industry,basing on the research status of patent technology at home and abroad.This paper analyzed the concentrated fields and patent distribution characteristics of tea industry patents from 2006 to 2016,compared the differences of patent distribution in the tea industry at home and abroad,and analyzed the problems in the process of creating,applying,protecting and managing the tea industry patents.It is of great theoretical significance and practical value for further strengthening the technical innovation work of the tea industry,better guiding enterprises to formulate patent development strategies,and promoting the transformation of the tea industry into a technology-driven direction.The research contents and main results are as follows:According to statistics by the end of 2016,there were 773,022 agricultural patent applications in China(including Hong Kong,Macao and Taiwan),the number of invention patent is 547,619,accounting for 70.84%,and the number of utility model is 225,403,accounting for 29.16%.The patents are mainly focuses on the food and biotechnology industry,which indicates that intensive production with advanced technology is becoming the driving force of China's agricultural development.From 2006 to 2016,the number of patent applications for tea industry in China(including Hong Kong,Macao and Taiwan)increased steadily,among which the authorization rate of invention patents increased from 68 in 2006 to 332 in 2013,with an average annual increase of 37.71%,however,the life cycle of invention patent in tea industry is still in the initial stage and technical development stage.The patent technology field is mainly distributed in the second and third industries,and the enterprises are the main force of technological innovation.The effective patent proportion of China is 39.45%,among which the effective utility model patent proportion is 53.81%.Fujian Agricultural and Forestry University ranks second in terms of the number of inventions and utility model patents in universities,Fujian province has the second highest number of patent applications,but the number of invention patent applications just ranks in the top five.From 2006 to 2016,the total number of foreign tea industry patent grants and authorization rates changed in a wave,reaching the peak in 2008.In addition to the traditional food processing field and the research of tea products or equipments,the foreign tea industry patent technology occupies a large proportion in the fields of medicine,veterinary medicine,hygiene,transportation,packaging,storage and transportation materials,and the patent concentration is higher than China.At present,there are "four lows and five shortages" in the development of new technology patents in China.Such as,the proportion of invention patents,the proportion of patents in universities and research institutes,the degree of patent concentration of enterprises,and the proportion of effective patents are too low.The investment in research and development,the patent authorization rate and patent validity,the sense of enterprises' innovation,the cooperation between industry,universities and research institutes,the patent regulations and regulations are insufficient.In view of the situation and existing problems,this paper proposes to broaden channels of funding sources and encourage enterprises to increase investment in scientific research,stressing the cultivation of innovative talents and strengthening the innovation,enhancing technology thriving enterprise innovation consciousness and foster innovative enterprises,strengthen the integration of elements in order to realize the collaborative innovation,establish and perfect rules and regulations and regulate patent creation process;In terms of patent application channels,it is necessary to expand the field of technology research and extend the patent chain,strengthen the connection between patents and the market to expand the patent application channels,and give play to the role of technology intermediary to improve the rate of technology transaction;In terms of patent protection,enterprises should enhance their awareness of patent protection,enhance their ability to provide evidence for infringement,strengthen patent protection and increase the cost of breaking the law;In terms of patent management ability,we should establish patent management awareness and enhance patent management ability,improve patent management mechanism and establish patent incentive mechanism.
