The labor contract is an agreement between the laborer and the enterprise(the employer)on the transfer of the right to use the labor factor.Since the reform and opening up,China has made great progress in establishing and standardizing labor contracts,which has effectively promoted the development of enterprises and the whole society.At the same time,there are still many problems in the performance of labor contracts.In the case of labor contracts can not effectively play a role,it is necessary to explore the control of the labor contract to promote the implementation of the mechanisms and means to seek effective response to the policy.This paper discusses the mechanism and means of labor contract performance by referring to the theory of control right,contract theory and team production theory.It is considered that the labor contract is not only incomplete contract,but also a difficult self-fulfilling contract.On the basis of this,this paper analyzes the necessity and mechanism of control,and puts forward the corresponding suggestions on how to improve the performance of labor contract from the point of view of production and distribution of control right.In addition to the introduction and conclusion,this paper is divided into four chapters.The first chapter,control and labor contract related basic theory analysis.This chapter first discusses the relevant theories such as control theory,incomplete contract theory,team production theory and so on.The second chapter,the nature of the labor contract and the difficulty of self-fulfillment of the labor contract.In this chapter,the author first discusses the nature of the labor contract,analyzes the meaning and principle of the labor contract,and the meaning and characteristics of the labor contract,and then analyzes the difficult self-fulfillment of the labor contract and concludes that it is difficult to self,and then put forward in the implementation of labor contracts need the role of control.The third chapter,the control mechanism to promote the performance of labor contract mechanism.The author puts forward the function of the exercising and controlling the control and the distribution function of the control right,analyzes the question of the implementation of the control right and the labor contract,and analyzes the necessity of the control to promote the performance of the labor contract by the model.Chapter 4,the means of control to promote the performance of labor contracts.From four aspects of the control of the labor contract to promote the implementation of the means,namely the development of codes of conduct,performance appraisal,the development of distribution policies,the implementation of the distribution policy.The fifth chapter,the control of drive for the implementation of the labor contract case analysis.Securities co.,LTD.,for example,from the basic situation of the company,the company's basic rules and regulations and the implementation of labor contract,labor contract,the basic situation of the labor contract to perform in the light of disputes and solutions from four aspects of case analysis.
