Research On The Legal Path Of Corporate Environmental Responsibility From The Perspective Of Energy Conservation And Emission Reduction

Corporate social responsibility generally refers to the environmental responsibility that the enterprise should take while it creates profits and takes legal responsibilities for shareholders.Additionally,it also takes the responsibility to employees,consumers and community.Corporate social responsibility demands enterprises have to give up their traditional idea that they should take the profit as the only goal,but they have to emphasize the value attention of employees and the contribution to environment,consumers and society.Enterprises will not take the negative effects of society and other individuals as the cost accounting if lack of the supervision.From the aspect of economics,companies will not be responsible for the negative externalities,but that is unbearable under the background of low carbon economy.It can be considered from the aspects from legislation of National People's Congress,administrative enforcement,the court of justice,law-abiding and public supervision when environmental responsibility of enterprises is investigated.Referring to the legislation,the laggardness of legislation and the absence of lecal system of companies' environmental responsibilities are the main causes.As the law enforcement,the loose government enforcement and insufficient enforcement methods towards environment pollution of enterprises are the two main reasons.Regarding to the incomplete judicial supervision,the scanty judicial resources of environmental litigation and the weak operability of environmental public litigation also contribute to the lack of environmental responsibility of enterprises.From the aspect of law-abiding,the weak awareness of environmental investment of companies and the lagging environmental management philosophy are the major reasons.When it comes to the mechanism of social supervision,the obstructed public supervision channel,the inadequate media supervision and the shortage of supervision of NGO contribute to the lack of environmental responsibility as well.From the perspective of perfecting the path of environmental liability under the idea of energy saving and emission reduction,the paper includes the following aspects:First,perfecting the legislation of environmental liability of enterprises in our country,including the legal system of perfecting corporate environmental responsibility.The second is to strengthen our corporate environmental responsibility in the respect of government management,increase the law enforcement of corporate environmental responsibility,and enrich the law enforcement means of corporate environmental responsibility.The third is to improve the corporate environmental responsibility of the judicial mechanism,the allocation of professional environmental litigation resources so that to increase practical operability of environmental public litigation;fourth is to enhance environmental responsibility awareness of compliance of corporate,strengthen the internal environment education in the companies,extensively implement clean production model and comprehensively utilize the environmental management strategies.Moreover,to strengthen the community's supervision role towards corporate environmental responsibility,broaden the channels of public participation in environmental supervision,enhance the supervision function of news media,and exert the supervision function of environmental protection NGO.Therefore,the core conclusion of this paper is:to enable enterprises to more effectively take the relevant corporate environmental responsibility under the new concept of energy-saving,emission reduction with the effort of legislation,law enforcement and judiciary together.In addition,to establish corporate environmental protection awareness and environmental protection capacity on the basis of the environmental responsibility of enterprises placed in a broader perspective of the inspection is also very important.The introduction of the public,news media,NGO and other aspects of supervision is significant for the formation of a complete responsibility system and supervision system.
