Research On The Legal System Of Hazardous Waste Management

Pollution prevention of hazardous wastes is an important content of Chinese ecological environmental protection.Management of hazardous wastes not only needs coordination in technology and management,but also needs economy and laws to standardize it.This paper summarized laws in hazardous waste management of China.Based on it,the author analyzed and defects in legal system of Chinese hazardous waste management;lack of management rules;unsoundness of management system;the level of supervision is not high;absence of information platform;and unclear corporate responsibility.Some developed countries(e.g.USA,Germany,UK and Japan)have already owned advanced legal system of hazardous waste management among which have the referential significance for our country.By summarizing experiences of legal system of hazardous waste management in these countries,the author proposed suggestions on improving Chinese legal system of hazardous waste management,such as formulation of refined hazardous waste management laws,construction of coordinated and uniform hazardous waste management system,reinforcement of overall process supervision of hazardous wastes;construction of hazardous waste informatization platform,and clear responsibilities of enterprises and public in hazardous waste management system.
