China is the largest consumer and producer of chemical products in the world.In the chemical industry,accidents of hazardous chemicals occurred frequently,causing a large number of casualties,losses and environmental pollution.China’s chemical management system has been gradually improved,but new problems that exposed in the chemical production need to be solved.Emergency management is an important part of the management system of hazardous chemicals.It’s worth studying that how the emergency legal system of hazardous chemicals can provide guarantees for safety.Based on the perspective of environmental law,this article analyzes characteristics of hazardous chemical accident which is different from other accidents.There are some emergency management problem on legal system,management system and institutional measures,such as the fragmented legal system,insufficient environmental protection,imperfect management system and measures,by analyzing the legal system and the recent hazardous chemical accidents.With the comparison of the foreign successful experience,it found some inspiration that many countries attach great importance to the emergency management of hazardous chemical accident.They have formed a comprehensive legal system for it and improved the emergency methods to avoid environmental pollution and great losses.In the end of the article,it offers a proposal which can improve our legal system.Firstly,integrating emergency management laws and strengthening the connection with environmental laws should be taken into consideration.Secondly,we can strengthen the collaborative management with the Environmental Protection Agency,and give chemical industry park the power of emergency management.Finally,in the term of the emergency measures,those suggestions include:(a)improving emergency plans for hazardous chemical accidents;(b)improving the corporate chemical information disclosure and information report;(c)expanding the form of supervision by introducing public interest litigation;(d)strengthening the accountability system for the emergency process.
