Research On Military Punishment By The Nationalist Government In Wartime (1937-1945)

In 1937,the anti-Japanese war broke out,and the approaching of the Japanese army caused enormous military pressure on the National Government.In order to rectify military discipline and maintain social stability,the National Government has promulgated numerous military law provisions,founded specialized military law institutions,and established a basic military law operation mechanism.At the same time,due to the consideration of the troubled times,the National Government has continued to expand the scope of application of military law and promote the rapid rise of military law authority.However,with the development of the war situation,the National Government continued to maintain high expectations for the military law,but did not continue to provide strong support for the military law.For lacking of sufficient economic subsidies on the one hand and having no independent political status on the other hand,it gradually gone off the tails and caused a series of adverse effects:the military law personnel are not well-balanced,the military institutions are subject to constraints,the military law operation mechanism is not perfect,and the military law trial power is repeatedly changed.The shortcomings in these aspects have further led to the actual punishment of military law far beyond the scope of jurisprudence.Under the influence of many factors,the final judgment is not only a comprehensive consideration in a complicated situation,but also a comprehensive reflection of the Kuomintang political culture.
