My Country Has Established A Separate Legislation Study On The Crime Of Assault On The Police

With the further development of the country's political,economic,and cultural,all sectors of society contradictions increasingly sharp,for the maintenance of social stability,highlighting the importance of the national law enforcement officers.However,society against national law enforcement main body gradually increased.According to incomplete statistics,since 2010,the investigation has been assaulting intrusion alarm cases increased at an average rate of more than 1000,the number of police abuse is leaping soared.China's current laws and regulations have not yet set up a separate police crime this crime.Academic circles to establish the crime of assaulting police officers filed a discussion,for whether to set up the crime of assaulting a police officer,both positive and negative divisive,did not come to the final conclusion.Our country's legislative process of assaulting the social harm were considered,during the 2003 national "two sessions",35 deputies proposed to increase the "crime of assaulting the police officer",In 2015 introduced the criminal correction in case(9)article 227 increase of violent attacks are enforcing the provisions of the duties of the people's police will be severely punished.Assaulting incident is not only to the police and other law enforcement body produce serious harm,and the stability of the social order produce adverse effects.Therefore,the research on how to protect the legitimate rights and interests of the police and other law enforcement main body and how to prevent and curb violence assaulting incident occurrence is very necessary.In this paper,the research is mainly divided into five parts.The first part mainly introduces what is assaulting behaviors,including the concept of the behavior of Interpol,types,characteristics and behavior of the harmfulness of assaulting a police officer.Part 2&3 are the necessity and feasibility analysis of assaulting the police,mainly from the legal system of our country,the crime of assaulting a police officer in the social harmfulness and the crime of assaulting a police officer to establish the authority of the police,the police protection four aspects.The fourth part is the introduction of Anglo-American law system and continental law system countries assaulting the overview of this crime,the fifth part is the separate legislation of the crime of assaulting a police officer,including the component elements of the crime of assaulting a police officer,legal punishment and sentencing plot,and the crime of assaulting a police officer problems should be paid attention to in the judicial application.The author hope that through to set up legislation of the crime of assaulting a police officer,on the basis of the analysis of relevant information,to find the causes of violent crime assaulting a police officer,can help deal with the increasing incident of assaulting a police officer in China and provide the beneficial reference.
