On The Construction Of My Country's Compulsory Medical Liability Insurance System

As a highly and professional activity,medical dispute brings lots of trouble to the hospital and patients and threaten to the society.Medical liability insurance plays an important role in dispersing the medical risk and protecting the interest of patients.However,medical liability insurance doesn't works very well in modern China and exposes some problems.Compulsory medical liability insurance comes into being and makes up for the defects of medical liability insurance.Some places started to build compulsory medical insurance and achieved great success like Beijing,Shanghai and Shenzhen,which eases social contradiction.Meanwhile,the compulsory medical liability insurance protect the interests of patients,distract medical risk and makes the society harmony.This paper puts and explore some methods of construction of compulsory medical liability insurance.In this paper,we used empirical analysis and comparative analysis to expound the compulsory medical liability insurance system through four parts.The first part,this paper introduces the background of that and analyze voluntary medical liability insurance's role in dispersing the medical risk and protecting the interest patients.However,there are some problems in the current development,such as the lack of mandatory and the defects in insurance terms and so on.The second part describes the implementation of compulsory medical liability insurance and analyzes the rationality of the existence of it as well as the successful experience of the pilot areas in our country.The third part puts forward some enlightenment on the building of compulsory medical liability insurance by analyzing and comparing the development and experience of medical liability insurance in foreign countries.The fourth part puts forward some suggestions on the building of compulsory medical liability insurance from the aspects of the principles,specific legal system recommendations and supporting facilities.Hoping for contributing meager strength for the development of compulsory medical liability insurance system.
