Research On The Improvement Of The Legal Review System For Major Administrative Law Enforcement Decisions

Administrative law enforcement is the core link of the government's social governance,and it is an important way to safeguard the rights of the people and promote the development of social reform.The improvement of the administrative level in accordance with the law is an important content of the implementation of the effective system of the rule of law.It is an inevitable requirement for the comprehensive promotion of the rule of law and the construction of a socialist country ruled by law."The outline of the implementation of construction of government by law(2015-2020 years)" proposed,"strict implementation of major administrative enforcement decisions by the audit system,without legal audit or audit did not pass,shall make a decision".As a specific innovation system put forward by the rule of law government,the major administrative enforcement of law decides that the system of legal examination is conducive to improving the decision-making mechanism of major administrative law enforcement and ensuring the fairness of major administrative enforcement decisions.In 2017 the State Council issued the "implementation of the record system of administrative law enforcement system of public law enforcement of major law enforcement legal decision audit system pilot work plan"(hereinafter referred to as the "pilot program"),to determine the pilot in Tianjin City,Hebei Province,Anhui Province,Gansu Province,the Ministry of land and resources and the city of Hohhot in 32 place and department."Pilot program" although the pilot unit's legal audit body,audit scope,audit contents and audit procedures for the provisions in principle,but in the actual operation of major administrative enforcement decisions involved in legal practice work of audit is far more than the range covered by the above four aspects.Therefore,it is of great practical significance to study and improve the system of legal review of major administrative law enforcement decisions.This paper adopts theoretical research and empirical analysis to study the relevant theories of major law enforcement decisions.Besides introduction and conclusion,this paper consists of three parts.The first part briefly introduces the research of major administrative enforcement decisions by the audit system,combined with the interpretation of the relevant documents,the author tries to determine the legal audit system from the major law enforcement background,concept and scope,analyzes the major administrative enforcement decisions on the definition and connotation of legal audit system.The second part,starting from the practical problems encountered by the grass-roots administrative law enforcement agencies,analyzes the main links in the four aspects,namely,the main body of the major law enforcement decisions,the scope of the audit,the contents of the audit,and the audit process.The third part,aiming at the problems and reasons in the practice of law enforcement system decided by major law enforcement,puts forward the way to select and improve the system of major law enforcement decision system of legal examination.
