A Study On The Legal Examination System Of Major Administrative Law Enforcement Decisions

Major administrative enforcement decision audit legal system refers to the administrative organ before making major decisions on administrative law enforcement,the legal system of audit institutions to review the legitimacy and rationality,the administrative organ in accordance with the procedures for review,make a written processing opinion,and without the legal audit or audit not through the audit authority,shall not make a decision of a kind of audit activities.This system belongs to one kind of internal supervision,its function appears very important.The implementation of this system can not only further promote the rule of law,to a large extent to protect the legitimate interests of citizens,but also restrict and supervise the power of governance to make it more standardized.Since 2016,the legal review system for major administrative law enforcement decisions has been piloted in some local governments and departments across the country and has achieved remarkable results,so it has been further promoted nationwide.This system is a great innovation in the process of building a law-based government in China for a long time.In the process of its implementation and popularization,some problems have appeared.The obvious problems include unclear subject of legal examination,inconsistent scope,incomplete content and unclear result.Therefore,in the long run,it is necessary to actively explore the system,and its effect is self-evident.This paper consists of four parts: the first part starts from the research background of the topic,and then analyzes the domestic and foreign research situation respectively,and finally introduces the writing method of this paper.The second part mainly introduces the legal review system of major administrative law enforcement decisions in detail,and further understands the system by referring to relevant laws and regulations.Therefore,the author mainly analyzes the specific connotation of the system from its proposal,specific meaning and scope,and distinguishes the system from other related representative systems one by one to clarify the basic theory of the system.The third part mainly expounds the pilot situation of the system in the country,analyzes the individual cases and summarizes the practical experience,and then discusses the problems and causes of the current system in China,so as to provide reference for the improvement and development of the system.The fourth part is a further outlook on the future development and improvement direction of this system.It is mainly improved from the five aspects of the audit body,audit content,audit scope,audit procedure and audit results,so as to ensure the accurate implementation of the system and promote the construction of a country under the rule of law.
