Research On The Legal Review System For Major Administrative Law Enforcement Decisions

The legal review system of major administrative law enforcement decisions is an internal supervision and restriction system in which the legal organs of administrative organs,in accordance with certain procedural requirements,aim at major administrative law enforcement cases before the administrative organs make a decision,examine its legality and appropriateness and put forward written opinions.As one of the most important systems in the construction of the rule of law in our country,it plays a positive role in preventing administrative law enforcement from violating legal norms,promoting administrative organs to strictly follow administrative law enforcement procedures,and enhancing the credibility of the public in administrative law enforcement.However,in practice,there are still some problems in the legal audit system of major administrative law enforcement decisions,such as non-neutrality of the audit subject,unclear content,non-uniform standards and so on,which need to be further improved.Based on the analysis of the relevant concepts of the legal review system of major administrative law enforcement decisions,this paper expounds the theoretical basis and principles of the legal review system of major administrative law enforcement decisions,and discusses the great significance of constructing the system.Combined with the practice of the system,this paper analyzes the problems and causes of the legal audit system,and puts forward some suggestions for improvement.The legal audit system for major administrative law enforcement decisions should play its due role in promoting administration according to law by improving legislation,standardizing the audit subject,defining the audit scope,unifying the audit standards and refining the audit procedures.
