In view of that analysis of the legal system of the medical profession in the time period,it is believed that the important role in the folk medicine rescue is customary law and the charitable organization of the folk in the course of civil medicine rescue, except the medical system specified by national laws.In particular, the good society and the good church of the Ming and Ming dynasties, the center of the entire civilian medicine industry,is affecting the progress and development of the people's medical practice in the Ming and qing dynasties. At the time of the Ming and Ming,we set up a place to protect the health organization of the people's drug administration, and to build a social welfare organization like clan relief, the local gentry, and so on,to help the civilians with medical care; And the establishment of medical education institutions in the local area promotes the development of medical industry. But due to the existence of class consciousness, the royal family and the civilian class are inversely proportional to their proportion in medical care.In order to ensure that civilians can also receive medical assistance, some private charity organizations have begun to participate in private medical assistance, except for formal medical institutions.During the Ming and qing dynasties, the imperial edict was adopted by the emperor to give recognition to the practice of folk medicine. At this point, the common law of folk medicine began to be established, such as the series of measures such as "giving medical aid to the people" and "burying bones" in order to prevent the disease.During the Ming and qing dynasties, influenced by the level of economic development, the non-governmental charity organizations that had already started in ancient China formed a scale at this time, and began to develop and grow in the southern part of the Yangtze river, forming the main force of the charity activities in China.Importantly, the charitable organizations at this time also became the main source of the aid of private medical industry, which made the folk medicine industry become a new one.Yat sen villa in the past, our country basic in self-sufficient natural economy period, although bud of capitalism, but little impact on the traditional agricultural society, will not be enough to affect China's social economic structure,so before the opium war,the folk charitable aid the quantity, scale, although small, but can meet the demand. After the opium war, with the development of commodity economy, the agricultural population moved to the cities and promoted the transformation of traditional handicraft industry and commerce into capitalism. With a large number of unemployed people flooding into cities, traditional philanthropic assistance has not been able to meet the needs of social development.Traditional relief ideas and rescue modes have begun to change. In the late qing dynasty, the government began to carry out the "education and rehabilitation" in the relief of diseases, and the introduction of the new idea of charity relief changed the traditional "foster" mode of rescue. There are some smart people in the area, and the main one is the squire power, and it plays a vital role in the new charity and medical relief. With the arrival of western missionaries and the spread of new ideas, the benevolent thought of "love as your own" in western Christianity has become a source of vitality for charitable organizations. From then on,the folk medicine industry in the late qing dynasty entered a new round of development, relying on private charity activities and flourishing. The continuity and inheritance of culture require that we should not break the history, not only to discuss the development of modern medical care system and the appropriate reform of medical system in the current social development. It is inevitable to draw on that experience of history,to develop the direction of the development direction of the modern social security system,so that the modern medical care enterprise can be develop wisely and lawfully. The paper will start from the medical industry in Ming and qing dynasties, and mainly discuss the benign operation of the folk medicine industry in the interaction between national law and customary law in this period,so as to influence the modern society. The theoretical study will not stop, and in the meantime, the development of medical practice in the country and abroad is going to be more thorough and more specific to the development of the medical industry in the qing dynasty. The article is based on the background of the legal system of the medical practice in the Ming and qing dynasty, and shows the strong link between the medical profession and the charity; And in the historical stages,it will crystallize the legal system of medicine in the qing dynasty, and to look at the rise and development of the medical profession in the centralized background.By contrast and thinking, based on the historical and cultural analysis,we summarize the characteristics of the medical legislation in the whole of the Ming and qing dynasty, trying to explore the causes of the history,to discover the social and political environment,to explore the enlightenment of the modern medical career,to find out and to present the most effective measures to the development of the modern medical health,to promote the reform of the medical system,to alleviate the problems of the medical profession, and to improve the modern healthcare system...
