Research On The Improvement Of The Administrative Decision-making Mechanism In Accordance With The Law In The Era Of Big Data

The Communist Party of China passed the "decision of the CPC Central Committee on several major issues comprehensively promote the rule of law" in the fourth Plenary Session of the 18th CPC Central Committee.The decision pointed out clearly that there still have been many unreasonable aspects in the legal construction at this stage,including bad law-abiding,loosely administration and illegal judicature.The administrative decision,which plays an important part of the law-based administration,is involved in various fields of social economy,culture,ecology and education.Since that administrative power has the nature of initiative,the government often needs to take the decision initiatively,which is closely related to public interests,and the vital interests of the people.But due to some national staffs or officers,which act as administrative decision-makers,are lacking the sense of following the law,there are phenomenon of substitute one's words for legal provision,suppress law with power,take bribes in order to turn a verdict in someone's favor,which lead to unstable factors affect social stability,like appeal by individuals and groups,parade petitions,vital mass incidents and so on.The arrival of the big data era brings new challenges to the administrative decision-making mechanism,but also the opportunity.In the new era of big data,administrative decision-makers must study the old defects in the administrative decision-making procedure carefully.They also need to be good at serving administrative decision-making by using the development of technology.Firstly,they should research data intelligent decision-making system,build the risk model of administrative decision-making.The apartments should share data and information with each other as well.In addition,they ought to cascade their business when they make decisions.Secondly,they need to establish the list of power,public the information proactive,standardize the decision-making process,encourage public participation,assess the risk scientifically,strengthen the procedures such as examination and supervision,break the barriers between data,optimize the decision-making process,improve the level of legalization and scientification during making decisions.Last but not least,the value of legality and science,justice and efficiency,equality and democracy should be brought into the administrative decision-making procedure.Furthermore,the government should develop the independent value of the administrative decision-making procedure,improve the legalization of administrative decision-making,and promote the modernization of the governance system and capability with help of technology.
