Research On The Criminal Investigation Procedure Of Telecom Fraud

The continuous development of the wireless communication technology and the internet has brought convenience to people's life,but also be used by the Telecom fraud criminals,number of national telecommunications fraud cases showed a trend of blowout since 2011,and the value of the case is continuously improving,but the detection rate has not been high,and the involved value enhances unceasingly which caused great damage to people's property.In 2016,there were three cases of telecommunications fraud leading to the death of victims,Telecom Fraud has become the focus of social attention again.So how to improve the ability of fighting Telecom fraud crime has become a problem in the police for years.Which is based on the theory of criminal reason,I find that the imperfection of the legal system is an important reason for the formation and even high incidence of Telecom Fraud,it is found in the judicial practice,the existing investigation procedure have some problems in guiding the telecommunications fraud case handling,then decided from the perspective of improving the criminal investigation procedure to crack the problem of high incidence of Telecom Fraud.The introduction sets forth the background and reason for selecting this topic,the current situation of Telecom fraud crime,the research necessity and significance of investigation procedure of Telecom Fraud.This thesis is comprised of four chapters:The first chapter mainly include the concept,classiflcation and forming reason of the Telecom Fraud,and analyze the origin,characteristics and the development trend of the Telecom Fraud in the first section.Which is based on the theory of criminal reason in the third section,the causes of Telecom Fraud are discussed in detail from both internal and external causes,namely individual factors and external factors,it is pointed out that the imperfection of the legal system is an important reason for the formation and even high incidence of Telecom Fraud,from the view of procedural law guarantees the implementation of substantive law,I proposed to improve the criminal investigation procedure to crack the problem of high incidence of Telecom Fraud.In the second to the fourth chapter,the three problems are discussed in detail directly,each focus on the three aspects:existing rules and practices,problems,solutions.The conclusion is a summary of the whole thesis,and point out further research is needed to improve technical investigation procedure in the future.I hope that my shallow exploration of this thesis could improve the attention of the majority of the experts and scholars,who would focus on their study of the investigation procedure of Telecom Fraud,further improve the investigation in criminal procedure,speed up the process of legal system in China,and also could improve the ability and the level of combating Telecom fraud crime of police.Only in this way as policemen,we could ensure people' s lives and property safety,and so that people' s sense of security and satisfaction could be improved.
