An Analysis Of Obstacles And Ways Of Pursuing Escapes Outside Of Our Country

With the serious trend of economic and corruption-related crimes in China,the situations of criminals escaping overseas have become more frequent,being a chronic disease.Since the 18th National Congress of the Communist Party of China,our government attach great importance to anti-corruption.We launched the "Fox Hunting","Sky Net"action to crack down on corruptions and to retrieve corruption property,which have scored great achievement.However,our existing mechanisms of overseas pursuit still have some problems in practice,such as the limitation of extradition,the legal regulation of substitute measures and a higher law and application requirements of international cooperation in our country,still a long way to go.This thesis intends to use the specific case of Yang Xiuzhu as an entry point,which is typical and a extremely hot case in recent years.It is both novel and comprehensively reflects the major problems in the pursuit mechanism of China.Therefore,from the point of view of the legal battle behind Yang Xiuzhu's 13 years of absconding.Then summary the underlying causes and methods of her hiding in various countries and obtained the main problems of our overseas pursuit mechanism.Under the guidance of the "United Nations Convention against Corruption" and the lessons learned from the international practice rules,a deep analysis will be conducted to further refine and explore the extradition,its alternative mechanisms and more international cooperation approaches.This thesis is divided into three chapters,which is composed of the following parts:The first chapter is mainly introduced by the facts of the case,introducing the route of Yang Xiuzhu's escape and her means adopted to evade the pursuit of our judicial organs.To analyze the problems exposed by Yang Xiuzhu's escape from both law and practice,and sums up a series of issues of pursuit work in China from her escape strategy.The second chapter summarize the status of China's overseas pursuit from both angles of legislation and practice.It also compares and analyzes the obstacles China faced in the process of cross-board pursuit,which incidentally draw out the third chapter.The third chapter proposes some relevant suggestions for the various problems encountered in the overseas pursuit mentioned above,and explore new path that we need.To use the Convention to improve extradition and alternative measures,and make recommendations from prevention mechanisms,talent teams conduction and international cooperation,etc.
