A Study On Alternative Measures Of Extradition In Pursuit Of Overseas

The criminals,especially the corruption in economic criminals,in the years before and after the incident often fled the country to avoid legal sanctions,since overseas pursuit has been China's punishment of corruption crime,difficulty to intensify anti-corruption efforts.Extradition is the most common and the most basic means in the pursuit of the outside world,but also the main basis for the pursuit of the majority of countries outside the country.However,due to the constraints of subjective and objective conditions,the use of extradition measures in China has some natural limitations,such as death penalty,asset sharing and so on.Based on this,firstly,from the analysis of China's overseas pursuit phenomenon,and expounds the connotation and principles of extradition,and made a detailed analysis on the limitation of extradition,then on the basis of conventional and non conventional alternative measures angle of alternative measures,points out several common types of alternative measures such as extradition.Repatriation,quanfan,prosecution offsite,kidnapping,deception,and then analyzes the current situation and problems of the implementation of extradition alternative measures,including the lack of legal basis and judicial jurisdiction is not determined,using alternative measures and further to foreign legal master is not deep,and finally puts forward some suggestions on how to resolve the the problem.
