Research On The Reform Of The Civil Executor System

The problem of "difficult enforcement" has long existed and has become a "bottleneck" that restricts the scientific development of the work of the people’s courts.In the past decade or so,courts at all levels of the enforcement work have made many efforts and achieved gratifying results,but the problems are very prominent.The level of law enforcement in the Executive Directorate is uneven,staff mobility is high,the number of staff is not enough,and the system of executive officers is not smooth,which has become a huge burden for the healthy development of the implementation work.In practice,The phenomenon that court leaders attach great importance to trial and less execution is a serious problem that needs to be solved,and is also the main reason for the present situation of the system of court executors in our country.Since the 18 Congress of the CPC,it has been running the country according to law in an all-round way.In order to protect the litigants’ rights and interests according to law,to gradually find the correct way to solve the difficult problem of execution,to turn the police enforcement into a visual angle,and to study the system reform of execution as the starting point,it is an effective way to explore the difficulty of execution.After extensive social investigation and research,on the basis of consulting a large number of papers,and proceeding from our own work practice,this paper finds out the practical problems faced and existing by our court executors,and through the method of research and comparison,This paper compares the law enforcement system of our country with that of some developed countries,and analyzes its advantages and disadvantages.The evolution of the court executor system in our country is studied empirically,and the law of its evolution and development is studied.In order to study the legal status of the court executors,we must first find out the jurisdiction of the courts and the legal status of the law enforcement officers in our country.The relationship of executive power,the current mode of separation of jurisdiction and enforcement power of Chinese courts.On the basis of choosing which mode the courts of our country should apply,the division of civil enforcement powers in enforcement procedures is made.Scientific argumentation is carried out from the theoretical and practical fields to lay a theoretical and practical foundation for the reform of the policing of the court executors in our country.At the present stage,the status quo of Executive Directorate reform is to carry out a limited external division within the Court,but only a simple division of labor within the Executive Directorate,which is also a detailed division of civil enforcement powers in the execution stage of the courts in our country.It provides a basis for practice.However,it still fails to solve the problems of disorderly service of court executors,low legal status,and the lack of deterrence of court executors with military and police symbols.Therefore,the only way is to reform the police officers of the courts.From the court completely separate,subordinate to the vertical leadership of the Supreme people’s Court,can solve the above problems.The premise of the establishment of the Police Executive Directorate is to first improve the executive from the system level.The top-level design of the system gives the executors certain powers of investigation and the power of military and police signs and equipment,integrates the police strength of the economic investigation detachment of the public security departments,and resolves the shortage of executive personnel.The establishment of a three-tier executive police bureau,and the establishment of a police bureau at the grass-roots level,with the aim of avoiding local protectionism.Leading cadres meddle in the maladies of cases.The study of the legal status of the executors and the civil enforcement system chosen by our country are two sides of the coin,so we study the issue of the legal status of the court executors.That is,to solve the problem of what kind of system should be adopted in civil enforcement in our country,so as to enforce the law.From the perspective of policing,the results of the establishment of the Executive Police Bureau to be solved by the Institute are consistent.
