On The Boundary Of Police Executive Power

In recent years,China has entered a period of social transformation,at this time,public security work is of great importance to the maintenance of social stability.But we are still facing many difficulties in the field of police executive power.While our legal system disposing the power to other administrative departments which ought to belong to the police,the police also have to help other administrative departments perform their duties.The police officers' work in the field of police executive and criminal justice could not be clearly separated.Our public security organizations hold the power to make restrictions of personal liberty for long time.And the police are completely exhausted while providing the social service,and the social organizations do not achieve their own goals to keep the order,and so on.The root cause for those problems is the the boundary of police executive power is not clear.The police executive power has the overlap with other administrative power,judicial power as well as private right,thus leads to the scope of police executive power being broke,the execution of police officers caused perplexity.The manifestations of the unclear boundary of police executive power is the police executive power has the overlap with other administrative power,judicial power,criminal executive power as well as private right,and it triggered many issues.The reason of the unclear boundary comes from many aspects,such as the power disposing and the power operation,moreover,the work units did not do their jobs at the field of safety.To draw a clear boundary for the police executive power,I discussed the dividing line between the executive power and legislative power,and the dividing line between the executive power and the judicial power.On the top of that,I elaborated the content of the police executive power,therefore we can distinguish the power that can not be included within the police executive power.After that,we can reach the boundary of it.Finally I try to design a way to draw a clear boundary for the police executive power.To achieve this goal,we should make both short-term and long-term efforts.In regard to short-term measures,there is an urgent need to specify the content of the police executive power,then return the power of urban management officers to the police officers.Moreover,we should reduce the number of non-police affairs which police should shoulder.Besides,we may urge the social organizations to bear their own responsibility.As for the long-term solutions,we may need to alter the way we were thinking when disposing the police power,than draw a clear line between the police executive power and other powers and individual rights through law making.On the top of that we can improve the level of our legal system for public security.Combining with the short-term and long-term measures,we can make the boundary more distinct,thus to solve the problems we are facing.And then make a better future for police officers.
