The Dilemma And Reflection Of The System Of Additional Restrictive Conditions For The Concentration Of Operators

Operator concentration is a “double-edged sword”.Concentration among enterprises is an important mechanism for boosting economic development and optimal allocation of resources.The vast majority of mergers do not harm the consumer.Instead,they bring substantial benefits to consumers at low prices,with higher quality goods or services and other innovative forms.However,there are still some transactions that,through unilaterally raising prices or curbing output,have coordinated and conspired to achieve huge market forces,and blockades of supply and sales have damaged fair market competition.These transactions reduce the overall efficiency of the economy and can cause serious damage to consumers.It is not wise to simply deal with the advantages,disadvantages,and disadvantages of the concentration of business operators.As an indispensable link in the anti-monopoly law and economic development,operators must concentrate on restrictive conditional systems.This year is our country by the anti-monopoly law of the 10 th anniversary of the restrictive conditions of system of challenge in the development of 10 years,achievement also highlights the legislation law enforcement time too short,many problems such as lack of experience,compared with Europe and the United States a mature system and a large room to improve.In view of this,starting from the status quo and challenges of the system,this article focuses on how to improve the system and conduct in-depth discussions and arguments.The text is divided into four chapters: the first chapter for the problem analysis,for the purpose of this article involves the related concept and the value of the system,such as basic theory is discussed,using the method of empirical analysis interpreted the competition effect of three different damage as a result,the foundation for the following argumentation.Chapter 2 as the restrictive conditions,the main way through restricted condition analysis of classification and comparison of advantages and disadvantages in different restrictive conditions were determined by the regulatory authorities focus and consideration,and clarify the different ways of applying for restrictive conditions and supervision requirements of the trustee.The third chapter for the analysis of the status quo,starting from the actual situation of our country legislation and enforcement,carding the current legislation and law enforcement,tries to analyze and summarize restrictive conditions system under the new situation brings changes and challenges.The fourth chapter is the sublimation part of this article,through the above three parts of the demonstration foreshore,the author tries to provide some useful references and Suggestions for the Chinese operator to focus on the restrictive condition system.We will focus on the specific industries in the new economy,improve the existing dispute settlement methods,increase the punishment,and set up new legal proposals for supporting the case.We should strengthen the independence of law enforcement departments,increase the resources of law enforcement,improve the transparency,and regulate the regulatory policies that are different from those of the behavioral conditions.
